One Ocean Breeze – St. Ives, Cornwall

Booking Terms and Conditions

This is a legally binding contract between the property owners of One Ocean Breeze and the holidaymaker.

(The property owners are also referred to as “we” and “us”.)   The holidaymaker is the person who completes the online booking form and  makes the payment. This person is responsible for ensuring all members of the holiday party accept & adhere to these terms and conditions. (The holiday maker is also referred to as “you”.)

Bookings are taken on a provisional basis and will be held for 24 hours while the Booking Deposit of 15%, of the total cost of the holiday, is paid.* Bookings are confirmed once the appropriate payment (credit/debit card or BACS) has been received into the owners’ bank account.  Until the booking is confirmed, it can be cancelled at any time by either party.

(*Bookings made less than 8 weeks before the arrival date must be paid in full at the time of booking.)

Payment of the Balance and Returnable Breakage Deposit of £200 needs to be paid by BACS at least 8 weeks before the holiday is due to start, otherwise the owners reserve the right to cancel the booking, and the Booking Deposit would be forfeited.

Please be sure to note the due date of this payment.

Bookings from groups of single people under the age of 30, or all male/all female groups, in excess of two, are not normally accepted.  Only people named on the Booking Form may stay in the property during the rental period. Prices quoted are for a maximum of 4 people.

Cancellation (by the holidaymaker)
In the event of cancellation, please advise the owners as soon as possible, so that we can attempt to re-let the property for the dates you have booked. If we are able to re-let those dates and, at the time of cancellation, you have only paid the Booking Deposit, that will be returned to you, minus a £50 admin fee. If we are able to re-let those dates and you have paid the full amount, we will pay you the amount we receive for that booking, minus a £50 admin fee.  If we are unable to re-let the property for your cancelled dates, all monies paid will be forfeited.

You are strongly advised to take out your own Holiday Cancellation Insurance at the time of booking, as we cannot be held responsible should you need to cancel or curtail your holiday for any reason.

Cancellation (by the owner)
If for any reason the property is not available for the dates booked (owing to fire/flood damage, for example) all rent paid by the holidaymaker will be refunded in full, and the holidaymaker shall have no further claim against the owners of the apartment.

Breakage Deposit  (This term covers the 6 sections listed below)
This will be refunded within 14 days of the end of the holiday, once the property has been checked and it has been confirmed that:-

  1. There has been no loss or damage to the property or contents
    (Please inform the owners about any difficulties or problems with the fixtures & fittings in the apartment, as soon as you can after arrival, so that we have an opportunity to rectify the situation as quickly as possible.)
  2. No additional cleaning has been needed
    (Guests are asked to leave the apartment in a clean tidy state when they depart)
  3. There is no evidence of smoking, candles, pets or extra people using the property
    (Only people included on the booking form may stay in the apartment – fire risk regulations)
  4. Keys are all accounted for and are in good working order
  5. Parking Permit is left on the table in the apartment for the next guests to use.
    (We understand Cornwall Council will charge in excess of £200 for a replacement permit !!)
  6. There has not been excessive use of utilities.
    (Gas, Electricity & Water are metered and normal usage is included in the rental price. In current times, when all utilities are scarce, precious and expensive,  we ask guests to be mindful of their use). 

A reserved parking space in Barnoon Car Park, opposite the apartment, is available for our holidaymakers to use. The owners of One Ocean Breeze cannot be held responsible, and accept no liability, if the space is unavailable due to circumstances beyond our control, e.g. illegal parking by another vehicle or Council maintenance.  The owners also accept no liability for any loss or damage to vehicles using this parking space.

Animals / Pets
Under NO circumstances are animals/pets allowed in the apartment.

Smoking and Candles
Smoking and the use of Candles are not permitted in the apartment, nor on the wooden decking area to the rear, as they pose a potential fire risk.

Holidaymakers’ Obligations
All holidaymakers agree –

  1. to keep and leave the apartment in a clean and tidy state
  2. to inform the owner of and pay for any breakages or damage
  3. not to cause a nuisance to neighbours
  4. to allow the owner/housekeeper/tradesperson reasonable access, if required
  5. that the apartment is let on the basis of Holiday Accommodation only
  6. to return the parking permit and keys to the dining table at the end of the stay

Durations and Times of Letting
Every effort will be made to have the property & parking space available from 3.00pm on the day of arrival.

The property & parking space must be vacated by 10.00am on the day of departure, unless otherwise agreed with the owners.  Holidaymakers have no rights to remain in the property other than for the agreed period.

Late departure may result in an additional charge being made.
(The cleaner has priority in the parking space from 10.00am to 3.00pm)

The owners accept no liability for any loss, damage or injury sustained by the holidaymaker or any members of their party in or around the apartment, hard standing or decking area. The owners accept no liability for the conduct of occupants or owners in neighbouring apartments and properties.  All holidaymakers are responsible for their own personal property.  The owners accept no responsibility for any loss or damage to any property brought onto the premises, howsoever caused.  Holidaymakers are responsible for checking the cover provided by their own insurance policies.

Bed Linen/Towels
All bed linen (with the exception of travel cot bedding) is provided.

Towels and bath mats are not provided, but can be hired, if requested at the time of booking.
If towels are hired, one bath mat is also provided for each bathroom.

Wi-Fi Broadband
This is available at no extra charge.  The owners cannot be held responsible for any service interruptions nor for any incompatibility with holidaymakers’ own equipment.
